Dear Client,
Thank you for your email and explanation of your expectations.
There are real asset protection tools for real estate and other assets. A lot of what you mentioned seems like “quick fix” options without considering the trickle-down consequence of transferring assets. Quick fixes have issues; they always do. Like anything else in life, a properly structured and well thought-out plan is necessary. Realize too that some experiences you may have had or witnessed may have been recommended and prepared by people or attorneys where asset protection is apart of their practice, instead of working with a professional where asset protection is their practice. There is a difference!
When dealing with individuals like yourself who know a lot about asset protection, much time is spent getting you to unlearn what you have learned. You know enough to be dangerous, but not enough to know what works and more importantly, WHY some things work and some don’t. Asset protection is not rocket science. It’s more an art form knowing which tools and techniques are properly used for which assets. There is no one tool right for every asset. Each asset has some tools that work better than others, but we need to consider the client. I can create a text-book perfect asset protection plan, but if you cannot implement it correctly, the plan falls apart. It’s a balance between protection and function, and because it’s more art than science, you will get different opinions about what works “best” from different people.
If you have assets worth protecting, then investing in barriers to litigation is money well spent. The primary goal is not to make you bullet-proof (this can never happen), but to make you unattractive in the eyes of a plaintiff’s attorney. So long as you implement your asset protection plan (whatever the plan – simple v. complex) before you have a problem, the plan is never a waste of money.
